All litigation is handled on an hourly retainer or on contingency.

  • Hourly Retainer: Depending on the nature of your case and your particular situation, we will ask you to make an initial retainer deposit of between $5,000 and $10,000. Sometimes the initial deposit amount will be higher. We bill all time spent on your matter at the hourly rate of the particular person completing the work. Litigation expenses are all charged against the deposit. When the deposit is close to exhausted, we will ask you to replenish the deposit.

  • Contingency: In a contingency case, we only get paid if you win damages in the case. We usually ask our contingency clients for a retainer deposit for litigation expenses only (not for our fees). Based on the complexity of your case and the timing of the settlement or trial, our firm will earn a percentage of your recovery. We take contingency cases on a case-by-case basis. If you think you have a case but lack the funds to pay us hourly, a contingency arrangement can make all the difference.  

Probate AND Trust Administration

  • Probate: Probate is a court-monitored process for making sure that property passes to those entitled to it after death. The process can be complicated and, depending on the complexity of the estate, lengthy. Our fees for acting as the attorney for the estate are set by state law, as a percentage of the assets passing through the estate. (See our Probate Calculator for details).
     
  • Trust Administration: Trusts have to be administered just like estates, but tend to be less expensive than probate administration. Our fees for advising trustees on proper trust administration are charged hourly, against a retainer deposit paid from the trust.

For individuals, our fixed planning fee for a living revocable trust package ranges from $4,000 up to $6,500. The package includes: a revocable living trust; two wills, two financial powers of attorney, two advanced health care directives, and other required documents. The actual fixed fee will be quoted at the end of a initial consultation, and is determined by:

  • The wishes and desires of the individual
  • The planning objectives the individual has for his or her property and family, including any desire for asset protection planning for the inheritance that is being passed on to children or other heirs
  • Building flexibility into the living trust to handle specific income tax, gift tax, generation skipping transfer tax, estate tax and/or real property tax planning objectives
  • The size of the estate, which may impact the estate planning objectives and the tax planning objectives, leading to a higher fee quote
  • If the individual has minor children, any special planning that is desired for the minor children

For married couples, our fixed planning fee for a living trust package ranges from $5,000 up to $7,500. The actual fixed fee will be quoted at the end of a initial consultation, and is determined by:

  • The wishes and desires of the couple
  • The planning objectives the couple has for their property and family, including any desire for asset protection planning for the inheritance that is being passed on to a surviving spouse, children or other heirs
  • Building flexibility into the living trust to handle specific income tax, gift tax, generation skipping transfer tax, estate tax and/or real property tax planning objectives
  • The size of the estate, which may impact the estate planning objectives and the tax planning objectives, leading to a higher fee quote
  • If the couple has minor children, any special planning that is desired for the minor children

For unmarried couples and registered domestic partners, our planning fee for a living trust package ranges from $6,000 up to $8,500, as two separate plans will need to be created. If only one partner wishes to do planning, then the rates for individuals noted above will apply. The actual fixed fee will be quoted at the end of a initial consultation, and is determined by:

  • The wishes and desires of the unmarried couple
  • The planning objectives each partner has for his or her property and family, including any desire for asset protection planning for the inheritance that is being passed on to  the other partner, children or other heirs
  • Building flexibility into the living trust to handle specific income tax, gift tax, generation skipping transfer tax, estate tax and/or real property tax planning objectives
  • The size of the estate, which may impact the estate planning objectives and the tax planning objectives, leading to a higher fee quote
  • If either or both partners have minor children, any special planning that is desired for the minor children
